OHCA State Plan Amendment Rate Committee (SPARC)

Background

Created by the Federal Balanced Budget Act of 1997, Section 4711 (a)(1), codified at 42 U.S.C. 1396a(a)(13)(A), Oklahoma’s Central Purchasing Act, 74 Okla. State § 85, 42 U.S.C. § 1396aa(30)(A), Subparts B, C, D, E, F and I of 42 C.F.R § 447, and 42 U.S.C. § 1396b (relating to administrative cost sharing and capitation rates for managed care).

Purpose

The Advisory Committee on Rates and Standards serves the rate setting process by conducting public hearings at which the public, vendors, and Oklahoma Health Care Authority staff are afforded the opportunity to provide testimony and documented evidence in support of rate recommendations.

The State Plan Rate and Standards Committee only operate to make recommendations for changes to rates and/or methodology that necessitate a State Plan Amendment.

Committee Membership

The Rates and Standards Committee is comprised of administrative and executive level staff designated by the Chief Executive Officer for the Oklahoma Health Care Authority.

Voting

A majority of the member of the State Plan Rates and Standards Committee (SPARC) (half of the members present) shall constitute a quorum for transaction of business for taking any official action. Official action of the SPARC committee must have a favorable vote by a majority of the members present.
